Rape Allegations in London and UK

The legal definition of rape is non-consensual sex. The provisions of Sexual Offences Act 2003 are quite explicit in this regard and describe rape or sexual assault as any form of penetration of the victim’s private part and/or mouth. Where the victim of the alleged crime did not consent to the sexual act and could not possibly have been deemed by the accused to have been consenting at the time, an allegation of rape may be brought. Even where sex is initially consented to, the new offence of non-consenting voyeurism means that should either or any of the parties withdraw consent at any given time, whatever sexual adventures or fantasies are pursued after such withdrawal may be treated as rape or sexual assault.

Consent therefore is a vital key. The inherent problem here however is the determination of what constitutes consent and how the law can determine when the alleged victim is merely crying foul. In our numerous years of experience, we have come across cases where the sexual offence of rape had been alleged against our clients who just happened to be prominent members of society. By going through every shred of evidence held against our clients with a toothpick, we were able to pick the prosecution’s case apart and to evidence that the so-called victim had merely been hoping for some substantial settlement out of court. This turn of events was all the more possible because the clients in question instructed us almost immediately after they became aware of the possibility of allegations being brought against them. This in turn afforded us ample time for case preparation.

Case preparation in rape cases can involve any number of a variety of things. The character and integrity of the alleged victim may need to be examined. The circumstances surrounding the alleged rape will be thoroughly examined as will the possibility of the victim’s consent remaining intact for most of the sexual act or if indeed it was ever withdrawn. We cannot stress the importance of time enough. It is an essential ingredient in criminal defence and should not be wasted for any reason whatsoever. The earlier you are able to entrust your case to the experts the better. Our criminal lawyer in London shows dedication to details that is second to none, and we will go to the additional mile to make sure that you are effectively represented.
